HomeExclusives Tue 10 September 2024 11:12, UKManchester City face potential risks if they are forced to appeal against any of the independent commission's findings in their 115 charges case against the Premier League.
That is the view of former Man City financial adviser Stefan Borson, who exclusively told Football Insider the English champions will be stuck with most of the initial findings, with an appeal primarily focused around points of law, misunderstandings and gaps in the judgement.
Man City were dealt the charges by the Premier League in February 2023 for allegedly breaching the financial fair play (FFP) rules over a nine-year period.
The hearing is expected to begin soon and is scheduled to last 10 weeks.
Pep Guardiola's side are likely to appeal against any potential punishment after their lawyers have been adamant the club haven't done anything wrong since the charges were handed out last year.
It was confirmed last week Leicester City have been successful after appealing against the Premier League's right to charge them with a profit and sustainability (PSR) breach.
MORE INSIDER STORIESMan City will be cautious about quality of independent commission Borson suggested Man City will be cautious about the difference in quality between the individuals selected for the independent commission compared to those on the appeal board.
He told Football Insider: "The fact the Leicester case has been decided in the way it has really has very little bearing on City.
"I think the biggest thing that City will probably be thinking about and cautious about is just the difference really in quality between the individuals that are selected for an independent commission versus those on the appeal board.
"The appeal board had two former Court of Appeal judges and another barrister hearing the case, whereas the original independent commission was not as senior, and the panel wasn't as high quality.
"You would not expect the lower level tribunal to be at the same level as the appeal.
But it does give City potential risk because a lot of the decisions that are made by that initial independent commission are unlikely to be able to be challenged in an appeal.
"If it went against City, a lot of the things that are found to be fact by that initial independent commission City will be stuck with.
The same goes the other way around for the Premier League.
